These Terms of Service govern your use of the products, services, courses, programmes, websites, and materials provided by Walsh Advisors, Inc. doing business as GenuineShift (trading as GenuineShift) at our website. By accessing or using any service, you agree to these terms and our Privacy Policy.

1. Acceptance and changes

By creating an account, purchasing a programme, accessing course materials, attending sessions, or otherwise using our services, you confirm that you have authority to accept these terms. We may update these terms from time to time, and the updated version applies from the date posted unless a different effective date is stated.

2. Our services

GenuineShift provides professional-development programmes, academies, training, resources, coaching, and related services for insurance and client-service professionals. Specific programme details, schedules, deliverables, and eligibility requirements may be described at the point of purchase or enrolment.

3. Accounts and access

You are responsible for maintaining the confidentiality of login credentials and for all activity under your account. You must not share credentials, copy restricted programme materials, or make course modules available to unauthorised people.

4. Payments

Fees, payment timing, taxes, and billing terms are shown at checkout, in an order form, or in a separate written agreement. Amounts are stated in $USD unless expressly stated otherwise.

5. Programme participation

Our programmes work when participants engage. Participants and sponsoring organisations are expected to attend, complete assigned work, communicate promptly about issues, and follow any programme-specific participation requirements.

6. Refunds, substitutions, and deferrals

GenuineShift programme terms are designed around active participation. Where a registered participant needs to defer before a session begins, we may allow movement to another start date in the same calendar year where feasible. If a participant leaves an organisation or cannot continue during the first 30 days of a programme, we may substitute another team member into the session as a courtesy where programme access and operational timing allow. After the first 30 days, refunds or substitutions are generally not available. Specific written programme terms provided at purchase or enrolment control where they differ from this section.

Programme videos, workbooks, frameworks, templates, recordings, and other materials are protected by United States copyright and intellectual property laws. You may use them for your own participation in the programme, but you must not share login credentials, play module videos for groups, reproduce materials, distribute materials externally, or reuse materials for other team members without written permission from GenuineShift.

8. Acceptable use

You must not misuse the website or services, interfere with security, attempt unauthorised access, upload malicious code, infringe intellectual property rights, or use the services in a way that violates applicable law.

9. Third-party services

Some services may rely on third-party platforms for hosting, payments, analytics, video, email, forms, or learning delivery. Use of those services may also be subject to the third party's own terms and privacy notices.

10. Disclaimers

Services and materials are provided for professional-development and educational purposes. They do not guarantee any particular business, employment, revenue, performance, or compliance result. To the fullest extent permitted by applicable United States law, services are provided without warranties not expressly stated in writing.

11. Limitation of liability

To the fullest extent permitted by applicable United States law, GenuineShift is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, loss of goodwill, or business interruption arising from use of the services.

12. Termination

We may suspend or terminate access if you breach these terms, fail to pay amounts due, misuse services, or create security, legal, or operational risk.

13. Privacy

Our handling of personal information is described in the Privacy Policy. Privacy rights and requests should be submitted through the contact us route.

14. Accessibility and support

Accessibility feedback and service requests should be submitted through our contact us route so they can be recorded and routed correctly.

If you believe content available through the services infringes copyright, submit a notice through our contact us route with enough detail for us to assess the request under applicable United States copyright law, including the Digital Millennium Copyright Act where it applies.

16. Dispute resolution and governing law

These terms are governed by the laws of the United States and the applicable laws of the state connected to the transaction or service relationship, without regard to conflict-of-law rules. Venue and dispute process may be further defined in an order form, customer agreement, or programme-specific written terms.

17. Ethical compliance

You and GenuineShift must comply with applicable United States anti-bribery, anti-corruption, sanctions, anti-money laundering, forced-labour, human-trafficking, and business ethics laws. Neither party may use the services to facilitate unlawful or unethical conduct.
